A computer model developed by the U.S. Environmental Protection Agency that calculates the economic benefit a violator gained by delaying or avoiding expenditures needed to comply with environmental requirements. Enforcement staff use the result when setting a civil penalty, adding it to a gravity component so that noncompliance does not cost less than compliance. BEN is one of several EPA penalty models, alongside ABEL for corporate ability to pay, INDIPAY for individuals and MUNIPAY for municipalities.
