Equitable subrogation
Term · Insurance and risk management · MLC-T-INS-001340
A legal doctrine allowing a party who has paid a debt or obligation of another to step into the shoes of the original creditor and assert that creditor's rights against the debtor. This principle applies when a party, without acting as a mere volunteer, pays a debt to protect its own interest or to prevent injustice. It is often invoked in mortgage and insurance contexts to prevent unjust enrichment.
