Anti-Backsliding

1. A provision in the Federal Regulations [CWA 303(d)(4); CWA 402(c); CFR 122.44(l)] that requires a reissued permit to be as stringent as the previous permit with some exceptions.

2. In general, a statutory provision that prohibits the renewal, reissuance, or modification of an existing NPDES permit that contains effluent limitations, permit conditions, or standards that are less stringent than those established in the previous permit.
