1. Records or information requiring, for national security reasons, safeguards against unauthorized disclosure. See also CLOSED FILE (2).
2. Defined in the Classified Information Procedures Act, 18 U.S.C. App. 3, section 1(a) as “any information or material that has been determined by the United States Government pursuant to an executive order, statute, or regulation, to require protection against unauthorized disclosure for reasons of national security.”
3. Official information which has been assigned a security classification category in the interest of the national defense or foreign relations of the United States.
4. Information that Executive Order 13526, ‘‘Classified National Security Information,’’ December 29, 2009 (3 CFR, 2010 Comp., p. 298), or any predecessor or successor order, or the Atomic Energy Act of 1954, as amended, requires agencies to mark with classified markings and protect against unauthorized disclosure.
5. Any knowledge that can be communicated or any documentary material, regardless of its physical form or characteristics, that - (1)(i) Is owned by, is produced by or for, or is under the control of the United States Government; or (ii) Has been classified by the Department of Energy as privately generated restricted data following the procedures in 10 CFR 1045.21; and (2) Must be protected against unauthorized disclosure according to Executive Order 12958, Classified National Security Information, April 17, 1995, or classified in accordance with the Atomic Energy Act of 1954.
