Confidential business information

1. Information that contains trade secrets, commercial or financial information, or other information that has been claimed as confidential by the submitter.

2. Material that contains trade secrets or commercial or financial information that has been claimed as confidential by its source (e.g. a pesticide or new chemical formulation registrant). EPA has special procedures for handling such information.

3. Includes information that is a trade secret or commercial or financial information from outside parties that has been claimed or determined to be confidential.

4. Information that contains trade secrets, commercial or financial information, or other information that has been claimed as confidential by the submitter. The EPA has special procedures for handling such information.

5. Commercial or financial information obtained by the government from a company on a privileged basis. Some examples include data or statements, trade secrets, product research and development, existing and future product designs and performance specifications.

6. Includes the concept of trade secrecy and other related legal concepts which give (or may give) a business the right to preserve the confidentiality of business information and to limit its use or disclosure by others in order that the business may obtain or retain business advantages it derives from its right in the information. The definition is meant to encompass any concept which authorizes a Federal agency to withhold business information under 5 U.S.C. 552(b)(4), as well as any concept which requires EPA to withhold information from the public for the benefit of a business under 18 U.S.C. 1905.

7. Business information for which a person has made a “business confidentiality claim” as defined in 40 CFR 2.201(h) and in accordance with all applicable provisions in 40 CFR part 2, subpart B, except insofar as the Administrator has denied the claim pursuant to the procedures in 40 CFR part 2, subpart B.

8. Trade secrets or confidential commercial or financial information under FIFRA section 10(b) or 5 U.S.C. 552(b)(3) or (4).

9. Information that has been determined by a Federal agency, in accordance with its applicable regulations, to be a trade secret, or commercial or financial information obtained from a person and privileged or confidential and is exempt from required disclosure under the Freedom of Information Act (5 U.S.C. 552(b)(4)).
