Contract

1. A written or oral agreement between the evaluator and client that is enforceable by law. It is a mutual understanding of expectations and responsibilities for both parties.

2. A procurement contract under a grant or subgrant, and a procurement subcontract under a contract. (40 CFR Parts 30 & 31)

3. A mutually binding legal relationship obligating the seller to furnish the supplies or services (including construction) and the buyer to pay for them. It includes all types of commitments that obligate the government to an expenditure of appropriated funds and that, except as otherwise authorized, are in writing. In addition to bilateral instruments, contracts include (but are not limited to): awards and notices of awards; job orders or task orders issued under basic ordering agreements; letter contracts; orders, such as purchase orders, under which the contract becomes effective by written acceptance or performance; and, bilateral contract modifications. Contracts do not include grants and cooperative agreements covered by 31 U.S.C. 6301 et seq.

4. Written agreement between your group and another party (other than a public agency) for services or supplies necessary to complete the TAG project. Contracts include contracts and subcontracts for personal and professional services or supplies necessary to complete the TAG project.

5. Written agreement between an EPA recipient and another party (other than another public agency) or between the recipient’s contractor and the contractor’s first tier subcontractor.

6. Legally binding agreement or obligation that cannot be canceled or modified without substantial financial loss. [40 CFR 62.14101 (CFR 2018)]

7. A legal instrument by which a non-Federal entity purchases property or services needed to carry out the project or program under a federal award.
