  "definition": "1. Emissions of an air pollutant in excess of an emission standard. [40 CFR 51.100 (CFR 2013)]Emissions of an air pollutant in excess of an emission limitation.\n\n2. With respect to this subpart, results of any required measurements outside the applicable range (e.g., emissions limitations, parametric operating limits) that is permitted by this subpart. The values of measurements will be in the same units and averaging time as the values specified in this subpart for the limitations.\n\n3. Specified averaging period over which either:(1) The NOX emissions are higher than the applicable emission limit in § 60.332;(2) The total sulfur content of the fuel being combusted in the affected facility exceeds the limit specified in § 60.333; or(3) The recorded value of a particular monitored parameter is outside the acceptable range specified in the parameter monitoring plan for the affected unit.\n\n4. Emissions in excess of those that would have occurred if there were no start-up, shutdown, or malfunction and the owner or operator complied with the relevant provisions of this subpart. [40 CFR 63.1082 (CFR 2013)]\n\n5. Results of any required measurements outside the applicable range (e.g., emissions limitations, parametric operating limits) that is permitted by this subpart. The values of measurements will be in the same units and averaging time as the values specified in this subpart for the limitations.\n\n6. Any tonnage of sulfur dioxide emitted by the affected units at an affected source during a calendar year that exceeds the Acid Rain emissions limitation for sulfur dioxide for the source; and any tonnage of nitrogen oxide emitted by an affected unit during a calendar year that exceeds the annual tonnage equivalent of the Acid Rain emissions limitation for nitrogen oxides applicable to the affected unit taking into account the unit's heat input for the year.\n\n7. Any tonnage of nitrogen oxides emitted by a NOX Budget unit during a control period that exceeds the NOX Budget emissions limitation for the unit. Any ton, or portion of a ton, of sulfur dioxide emitted by the CAIR SO2 units at a CAIR SO2 source during a control period that exceeds the CAIR SO2 emissions limitation for the source, provided that any portion of a ton of excess emissions shall be treated as one ton of excess emissions.\n\n9. Any ton of nitrogen oxides emitted by the CAIR NOX units at a CAIR NOX source during a control period that exceeds the CAIR NOX emissions limitation for the source.
