Experimental Use Permit

1. Obtained by manufacturers for testing new pesticides or uses thereof whenever they conduct experimental field studies to support registration on 10 acres or more of land or one acre or more of water.

2. A permit granted by EPA that allows a producer to conduct tests of a new pesticide, product and/or use outside the laboratory. The testing is usually done on ten or more acres of land or water surface.

3. Review of an application for a permit pursuant to section 5 of FIFRA to apply a limited quantity of a pesticide in order to accumulate information necessary to register the pesticide. The application may be for a new chemical or for a new use of an old chemical. The fee applies to such experimental uses of a single unregistered active ingredient (no limit on the number of other active ingredients, in a tank mix, already registered for the crops involved) and no more than three crops. This fee does not apply to experimental use permits required for small-scale field testing of microbial pest control agents [40 CFR 172.3 (CFR 2013)]

4. Permit authorized under FIFRA section 5 that allows applicants to develop data to support an anticipated registration application. 40 CFR Part 172 provides more detail on which data collection activities may require an EUPs.
