1. A facility or mobile source that emits pollutants into the air; any person who produces a hazardous waste that is listed by EPA and therefore subject to regulation.

2. A facility or mobile source that emits pollutants into the air or releases hazardous waste into water or soil.

3. Any person whose act first creates or produces hazardous waste.

4. Any person, by site, whose act or process produces regulated medical waste or whose act first causes such waste to become subject to regulation. Where more than one person (e.g. doctors with separate medical practices) are located in the same building, each business entity is a separate generator.

5. Any person, by site, whose act or process produces hazardous waste identified or listed in part 261 of this chapter or whose act first causes a hazardous waste to become subject to regulation. 6. Any person, by site, whose act first creates or produces a hazardous waste, used oil, or medical waste, or first brings such materials into RCRA regulation.
