New source performance standard

  1. 1. Technology-based standard for facilities that qualify as new sources under 40 CFR 122.2 and 40 CFR 122.29. A standard considers that the new source facility has an opportunity to design operations to more effectively control pollutant discharges.

    2. NSPS, or New Source Performance Standard, is an emission standard prescribed for criteria pollutants from certain stationary source categories under Section 111 of the Clean Air Act.

    3. A standard for an industrial or source category, as published in 40 CFR Part 60 of the CAA, limiting pollutant levels from new stationary sources.

    4. Technology standards for facilities that qualify as new sources under § 122.2 and § 122.29. Standards consider that the new source facility has an opportunity to design operations to more effectively control pollutant discharges.

As a result, NSPS should represent the most stringent controls attainable through the application of the best available demonstrated control technology for all pollutants (i.e., conventional, non-conventional, and priority pollutants). In establishing NSPS, the EPA is directed to take into consideration the cost of achieving the effluent reduction and any non-water quality environmental impacts and energy requirements.
