Procuring Agency

1. Any federal agency, or any state agency or agency of a political subdivision of a state, that is using appropriated federal funds for procurement.
2. Agencies that purchase $10,000 or more worth of an item designated under the federal procurement program during the course of a fiscal year. Procuring agencies include: federal government departments or agencies; state government agencies that use appropriated federal funds for procurement of a designated item; local government agencies that use appropriated federal funds for procurement of a designated item; and government contractors that work on a project funded by appropriated federal funds with respect to work performed under the contract.
3. Any Federal agency, or any State agency or agency of a political subdivision of a State, which is using appropriated Federal funds for such procurement, or any person contracting with any such agency with respect to work performed under such contract.
