Toxic pollutant

  1. 1. A pollutant or combination of pollutants, including disease-causing agents, which after discharge and upon exposure, ingestion, inhalation or assimilation into any organism, either directly from the environment or indirectly by ingestion through food chains, will, on the basis of information available to the Administrator of EPA, cause death, disease, behavioral abnormalities, cancer, genetic mutations, physiological malfunctions, (including malfunctions in reproduction) or physical deformations, in such organisms or their offspring. Toxic pollutant also includes a pollutant listed by the Administrator under CWA Section 307(a)(1) or any pollutant listed under Section 405(d) which relates to sludge management.

    2. Pollutant listed by the EPA Administrator under CWA section 307(a). The list of the current 126 toxic pollutants can be found at http://water.epa.gov/scitech/methods/cwa/pollutants.cfm.

    3. Any pollutant listed as toxic under section 307(a)(1) or any pollutant identified in regulations implementing section 405(d) of the CWA.

    4. Any pollutant listed as toxic under section 307(a)(1) or, in the case of “sludge use or disposal practices,” any pollutant identified in regulations implementing section 405(d) of the CWA.

    5. Those substances listed in 40 CFR 401.15.

    6. Those pollutants listed by the Administrator under section 307(a) of the Act.

    7. Toxic (priority) pollutants are those defined in CWA section 307(a)(1) (and listed in § 401.15 and Appendix A of Part 423) and include 126 metals and manmade organic compounds (see Exhibit C-1 in Appendix C of this document).

    8. Materials that cause death, disease, or birth defects in organisms that ingest or absorb them. The quantities and exposures necessary to cause these effects can vary widely.

    9. Pollutant listed by the EPA Administrator under CWA section 307(a).

    10. Any pollutant listed as toxic under CWA section 307(a)(1) or, in the case of sludge use or disposal practices, any pollutant identified in regulations implementing CWA section 405(d).
