Universal Waste

1. Means any of the following hazardous wastes that are managed under the universal waste requirements of 40 CFR part 273 (http://www.gpo.gov/fdsys/pkg/CFR-2012-title40-vol28/xml/CFR-2012-title40-vol28-part273.xml): (1) Batteries as described in 40 CFR 273.2 (http://www.gpo.gov/fdsys/pkg/CFR-2012-title40-vol28/xml/CFR-2012-title40-vol28-sec273-2.xml); (2) Pesticides as described in 40 CFR 273.3 (http://www.gpo.gov/fdsys/pkg/CFR-2012-title40-vol28/xml/CFR-2012-title40-vol28-sec273-3.xml); (3) Mercury-containing equipment (including thermostats) as described in 40 CFR 273.4 (http://www.gpo.gov/fdsys/pkg/CFR-2012-title40-vol28/xml/CFR-2012-title40-vol28-sec273-4.xml); and (4) Lamps as described in 40 CFR 273.5 (http://www.gpo.gov/fdsys/pkg/CFR-2012-title40-vol28/xml/CFR-2012-title40-vol28-sec273-5.xml).
2. Commonly recycled wastes with special management provisions intended to facilitate recycling. There are three categories of universal wastes: hazardous waste batteries, hazardous waste pesticides that have been recalled or collected in waste pesticide collection programs, and hazardous waste thermostats.
3. Any of the following hazardous wastes that are managed under the universal waste requirements of part 273 of this chapter:(1) Batteries as described in § 273.2 of this chapter;(2) Pesticides as described in § 273.3 of this chapter;(3) Mercury-containing equipment as described in § 273.4 of this chapter; and 4) Lamps as described in § 273.5 of this chapter.
4. Any of the following hazardous wastes that are managed under the universal waste requirements of 40 CFR part 273 (1) Batteries as described in 40 CFR 273.2 (2) Pesticides as described in 40 CFR 273.3 (3) Mercury-containing equipment (including thermostats) as described in 40 CFR 273.4 and (4) Lamps as described in 40 CFR 273.5
5. Any of the following hazardous wastes that are subject to the universal waste requirements of this part:Mercury-containing equipment as described in § 273.4; Lamps as described in § 273.5; and Aerosol cans as described in § 273.6.[84 FR 67202; Increasing Recycling: Adding Aerosol Cans to the Universal Waste Regulations]
