Offer of judgment

A formal proposal made by one party in a lawsuit to the opposing party to settle the case for a specific amount. If the offer is rejected and the final judgment is less favorable to the rejecting party than the offer, that party may be liable for the offering party's post-offer litigation costs. This tool encourages settlement and can shift cost burdens.
