Summary judgment

Term · Insurance and risk management · MLC-T-INS-003237

A court's final decision in a civil case, such as an insurance coverage dispute, that resolves the lawsuit without a full trial. A party requests this ruling by arguing that the undisputed facts of the case, when viewed in the light most favorable to the other party, show that the requesting party is entitled to win as a matter of law. This procedure is used when there is no genuine dispute over any material fact, making a trial to determine facts unnecessary.
