Administrative Record

Term · Environment · MLC-T-ENV-000539

1. A set of documents that is the basis for any Federal agency administrative action, including, but not limited to, rulemaking. Under the Administrative Procedure Act (APA), any judicial review of a final agency action is based on the administrative record. Administrative actions that are not rules may include denials of citizens' petitions, individual permit decisions, and exemption decisions. These actions are typically based in an administrative record.

2. A file which is maintained and contains all information used by the lead agency to make its decision on the selection of a response action under CERCLA. This file is to be available for public review and a copy is to be established at or near the site, usually at one of the information repositories. Also, a duplicate file is held in a central location, such as a Regional or State office.

3. A compilation of documents supporting an administrative action; under Superfund, administrative actions often compel Potentially Responsible Parties (PRPs) to undertake or pay for hazardous waste site cleanups.

4. The body of documents that "forms the basis" for the selection of a particular response at a site. For example, the Administrative Record for remedy selection includes all documents that were "considered or relied upon" to select the remedy through the record of decision.

5. All documents which EPA considered or relied on in selecting the response action at a Superfund site, culminating in the record of decision for remedial action or, an action memorandum for removal actions.

6. A file that is maintained, and contains all information used, by an agency to make a decision pursuant to its authority under the Superfund law. The agency makes the administrative record available for public review. For the Lower Fox River project, the EPA Administrative Record will be available for review in the near future at EPA Region 5 in Chicago and at local Green Bay and Appleton area information repositories. The U.S. Fish and Wildlife Service (FWS) administrative record is available in a public reading room established at the FWS Green Bay office.
