Compliance Monitoring

1. Actions to monitor compliance with rules, including audits and inspections as well as direct measurement of pollutants or substances of interest in permitted discharges or in the ambient environment.

2. Compliance monitoring is one of the key components the Agency uses to protect human health and the environment by ensuring that the regulated community obeys environmental laws/regulations through on-site visits by qualified inspectors, and a review of the information EPA or a state/tribe requires to be submitted. http://www.epa.gov/compliance/monitoring/index.html

3. Collection and evaluation of data, including self-monitoring reports, and verification to show whether pollutant concentrations and loads contained in permitted discharges are in compliance with the limits and conditions specified in the permit.

4. Compliance monitoring in the field includes witnessing of mechanical integrity, and other well testing, and conducting inspections including routine, compliance and complaint inspections. All Class I wells are visited at least once per year. All Class II, Class III and Class 5X16 wells are visited at least once every five years to witness the mechanical integrity testing on the well. The compliance monitoring program in the office includes review of monitoring documents submitted by regulated entities, review of mechanical integrity testing results submitted by regulated entities and the contract field inspectors, results of inspections, review of regional files and computer database files to identify potential violations.

5. For purposes of RCRA TSDF ground water monitoring, a program that seeks to ensure that the amount of hazardous waste that has leaked into the uppermost aquifer does not exceed acceptable levels.

6. Compliance monitoring is one of the key components the Agency uses to protect human health and the environment by ensuring that the regulated community obeys environmental laws/regulations through on-site visits by qualified inspectors, and a review of the information EPA or a state/tribe requires to be submitted. EPA also promotes compliance incentives and auditing to encourage facilities to find and disclose violations to the Agency. Violations may also be discovered from tips/complaints received by the Agency from the public. Violations discovered as a result of any of these activities may lead to civil enforcement or criminal enforcement. The Agency also provides compliance assistance to the regulated community to help them understand their requirements and to minimize or prevent violations from occurring at regulated facilities.
