Hazardous substance

  1. 1. CERCLA defines a hazardous substance as "(A) any substance designated pursuant to section 1321(b0(2)(A) of Title 33, (B) any element, compound, mixture, solution or substance designated pursuant to section 9602 of this title, (C) any hazardous waste having the characteristics identified in under or listed pursuant to section 3001 of the Solid Waste Disposal Act (but not including any waste the regulation of which the Solid Waste Disposal Act has been suspended by Act or Congress), (D) any toxic pollutant listed under section 1317(a) of Title 33, (E) any imminently hazardous chemical substance or mixture with respect to which the (EPA) Administrator has taken action pursuant to section 2606 of Title 15. The term does not (within the context of CERCLA) include petroleum, crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance (by CERCLA)...The term (hazardous substance) does not include natural gas, natural gas liquids, liquified natural gas, or synthetic natural gas usable for fuel (or mixtures of natural gas and such synthetic gas).

    2. Any substance, other than oil, which, when discharged in any quantities into waters of the U.S., presents an imminent and substantial danger to the public health or welfare, including but not limited to fish, shellfish, wildlife, shorelines and beaches (Section 311 of the CWA).

    3. Any substance identified by EPA as the pollutants listed under 40 CFR Part 116.

    4. A broad term that includes all substances that can be harmful to people or the environment; toxic substances, hazardous materials and other similar terms are subsets of hazardous substances.

    5. As defined in section 101(14) of the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) of 1980, but not including any substance regulated as a hazardous waste under subtitle C), "hazardous substance" means the following: (A) any substance designated pursuant to section 1321(b)(2)(A) of title 33; (B) any element, compound, mixture, solution, or substance designated pursuant to section 9602 of this title; (C) any hazardous waste having the characteristics identified under or listed pursuant to section 3001 of the Solid Waste Disposal Act (42 U.S.C. 6921) (but not including any waste the regulation of which under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.) has been suspended by Act of Congress); (D) any toxic pollutant listed under section 1317(a) of title 33; (E) any hazardous air pollutant listed under section 112 of the Clean Air Act (42 U.S.C. 7412); (F) any imminently hazardous chemical substance or mixture with respect to which the Administrator has taken action pursuant to section 2606 of title 15. The term does not include petroleum, including crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under subparagraphs (A) through (F) of this paragraph, and the term does not include natural gas, natural gas liquids, liquefied natural gas, or synthetic gas usable for fuel (or mixtures of natural gas and such synthetic gas)."     6. Any material that poses a threat to human health and/or the environment. Typical hazardous substances are toxic, corrosive, ignitable, explosive, or chemically reactive.

    7. Any substance designated by EPA to be reported if a designated quantity of the substance is spilled in the waters of the United States or is otherwise released into the environment.

    8. A comprehensive designation under CERCLA for RCRA hazardous wastes as well as other toxic pollutants regulated by CAA, CWA, and TSCA. EPA has the authority under CERCLA to designate any additional element, compound, mixture, or solution as a hazardous substance. The definition of hazardous substance specifically excludes petroleum and natural gas.

    9. Any substance designated under 40 CFR part 116 pursuant to section 311 of CWA.

    10. That group of substances defined as hazardous under CERCLA 101(14), and that appear at 40 CFR 302.4.

    11. As defined by section 101(14) of CERCLA, means:(1) Any substance designated pursuant to section 311(b)(2)(A) of the Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.);(2) Any element, compound, mixture, solution, or substance designated pursuant to section 102 of CERCLA;(3) Any hazardous waste having the characteristics identified under or listed pursuant to section 3001 of the Solid Waste Disposal Act (42 U.S.C. 6801 et seq.) (but not including any waste the regulation of which under the Solid Waste Disposal Act has been suspended by Act of Congress);(4) Any toxic pollutant listed under section 307(a) of the Federal Water Pollution Control Act;(5) Any hazardous air pollutant listed under section 112 of the Clean Air Act (42 U.S.C. 7401 et seq.); and(6) Any imminently hazardous chemical substance or mixture with respect to which the Administrator of EPA (Administrator) has taken action pursuant to section 7 of the Toxic Substances Control Act (15 U.S.C. 2601 et seq.). The term does not include petroleum, including crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under paragraphs (1) through (6) of this definition, and the term does not include natural gas, natural gas liquids, liquefied natural gas, or synthetic gas usable for fuel (or mixtures of natural gas and such synthetic gas).

    12. Any substance designated pursuant to 40 CFR part 302.

    13. Meaning given it in section 101(14) of the Act, 42 U.S.C. 9601(14).

    14. Any substance - as designated under Part 116 pursuant to CWA section 311 - that presents an imminent and substantial danger to the public health or welfare, including fish, shellfish, wildlife, shorelines, and beaches, upon discharge to navigable waters of the United States.

    15. A hazardous substance is any substance belonging to one of the following categories, exposure to which results or may result in adverse effects on the health of employees: Any elements, compounds, mixtures, solutions, and substances which when released into the environment may present a substantial danger to the public health or welfare or the environment, that are designated as such by the Administrator of EPA under Section 102(a) of CERCLA, in addition to those referred to in Section 101(14) of CERCLA; any biologic agent and other disease-causing agent which, after release into the environment and upon exposure will or may reasonably be anticipated to cause death, disease, behavioral abnormalities, cancer, genetic mutation, physiological malfunctions (including malfunctions in reproduction), or physical deformations in such persons or their offspring; any substance listed by the U.S. Department of Transportation as hazardous materials under 49 CFR 172.101 and appendices; a hazardous waste.

    16. Any material that poses a threat to public health and/or the environment. Typical hazardous substances are materials that are toxic, corrosive, ignitable, explosive, or chemically reactive.

  2. Hazardous substances consist of CERCLA hazardous substances, pollutants, and contaminants as defined in CERCLA sections 101(14) and 101(33), except as otherwise specifically noted in the HRS.
