1. A product that is not registered and can be either a Manufacturing Use Product (MP or MUP) or an End Use Product (EP). An MP or MUP is any pesticide product other than an end use product. A product may consist of the technical grade of active ingredient only, or may contain inert ingredients such as stabilizers or solvents. 40 CFR § 153(h). MPs are intended and labeled for formulation and repackaging into other pesticide products. An EP is a pesticide product whose labeling (1) includes directions for use of the product (as distributed or sold, or after combination by the user with other substances) for controlling pests or defoliating, desiccating, or regulating growth of plants, and (2) does not state that the product may be used to manufacture or formulate other pesticide products. 40 CFR § 153(b).
2. Product the equitable or legal title of which has never been transferred to an ultimate purchaser, or a product which is imported or offered for importation into the United States and which is manufactured after the effective date of a regulation under section 6 or 8 which would have been applicable to such product had it been manufactured in the United States.
