Toxicity Characteristic

1. Toxicity characteristic is one of the four criteria which define hazardous waste under Federal hazardous waste regulations. Title 40 of the Code of Federal Regulations (40 CFR) Section 261.24 lists 43 specific constituents and the regulatory level for each of these constituents. Any solid waste which has a concentration of any of these contaminants at or above the level listed in Table 1 of 40 CFR Section 261.24 is considered toxic and is therefore hazardous. (The other three characteristics are ignitability, corrosivity and reactivity, all of which are defined more precisely in 40 CFR Section 261.20 Section 261.21 and Section 261.22 .) 2. The characteristic which identifies wastes that are likely to leach dangerous concentrations of toxic chemicals into ground water.
