Consequential bodily injury suits

Suits by family members of an injured worker, such as a spouse, child, parent, or sibling, seeking damages for their own losses that result from the worker's bodily injury, for example loss of consortium or loss of services. Because the claimants are not the employee, workers' compensation exclusive remedy does not necessarily bar them against the employer. They are covered under Part Two, employers liability, of the standard workers' compensation policy rather than under general liability.
