Battle & Sons Funeral Home v. Chambers

Term · Law · MLC-T-LAW-000687

A 1993 Ohio municipal court decision on who controls the burial of a deceased parent. The court held that an adult child who had no normal parental and filial relationship with the parent at the time of death could not claim a paramount right, as nearest next of kin, to dictate the manner and place of burial. It is cited in mortuary law as a limit on the priority that next of kin ordinarily hold over disposition of remains.
