Secondary right of disposition

The authority granted to an individual to make decisions regarding the final disposition of a deceased person's remains, when the primary right holder is unwilling, unable, or fails to act. This right typically follows a statutory order of priority, such as next of kin. State laws establish the hierarchy of individuals who possess this authority.
