Encumbrance

A right or interest in a piece of real property held by someone other than the property owner, which can diminish its value or limit its use. Examples include mortgages, tax liens, easements, and restrictive covenants that run with the land. The existence of encumbrances is a key disclosure item in real estate transactions, revealed through a title search.
