Marital deduction

A provision in estate and gift tax law that allows a taxpayer to transfer an unlimited amount of assets to their spouse free of federal estate or gift tax. This deduction applies to transfers made during life or at death, provided the recipient spouse is a U.S. citizen. The assets transferred become part of the surviving spouse's taxable estate upon their death.
