Marital deduction trust

A type of trust designed to qualify assets transferred to a surviving spouse for the federal estate tax marital deduction. This allows the assets to pass to the spouse free of estate tax at the first spouse's death. The trust must meet specific Internal Revenue Code requirements, such as granting the surviving spouse a general power of appointment or qualifying as a Qualified Terminable Interest Property (QTIP) trust.
