Surviving spouse's trust

A legal arrangement established within a deceased spouse's will or revocable living trust to hold assets for the benefit of the surviving spouse. This trust provides for the surviving spouse's financial needs while alive, often with restrictions on principal distributions to preserve assets for other beneficiaries, such as children from a prior marriage. The terms of the trust dictate how income and principal are distributed and when the trust terminates.
