Top lease

A new oil and gas lease that becomes effective only after an existing, underlying lease expires or is terminated. This type of lease is acquired by a lessee who anticipates the termination of a current lease, allowing them to secure future drilling rights. Top leases are recorded in the public records but remain dormant until the primary lease is no longer in force.
