Petroleum product

All refined and semi-refined products that are produced at a refinery by processing crude oil and other petroleum-based feedstocks, including petroleum products derived from co-processing biomass and petroleum feedstock together, but not including plastics or plastic products. Petroleum products may be combusted for energy use, or they may be used either for non-energy processes or as non-energy products. The definition of petroleum product for importers and exporters excludes waxes.
Petroleum is defined under CERCLA as "crude oil or any fraction thereof which is not otherwise specifically listed or designated as a hazardous substance under subparagraphs (A) through (F) of this paragraph, and the term does not include natural gas, natural gas liquids, liquefied natural gas, or synthetic gas usable for fuel (or mixtures of natural gas and such synthetic gas)." (40 USC Section 9601). Please note that the Brownfields Law restricts eligibility for EPA brownfields funding to petroleum contaminated properties that EPA or the state determines: (1) are of "relatively low risk" compared with other "petroleum-only" sites in the state; and (2) for which there is no viable responsible party and will be assessed, investigated, or cleaned up by a person that is not potentially liable for cleaning up the site. In addition, petroleum-contaminated properties must not be subject to a corrective action order under a Resource Conservation and Recovery Act (RCRA) Section 9003(h) order.
