Storage Vessel

1. Tank or other vessel that is used to store liquids that contain one or more organic HAP. Storage vessels do not include:(1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere;(3) Vessels with capacities smaller than 38 cubic meters;(4) Vessels and equipment storing and/or handling material that contains no organic HAP and/or organic HAP as impurities only;(5) Wastewater storage tanks; and(6) Surge control vessels and bottoms receivers.

2. Tank or other vessel that is designed to contain an accumulation of crude oil, condensate, intermediate hydrocarbon liquids, or produced water and that is constructed primarily of non-earthen materials (e.g., wood, concrete, steel, plastic) that provide structural support. The following process units are not considered storage vessels: Surge control vessels and knockout vessels.

3. Any tank, reservoir, or container used for the storage of petroleum liquids, but does not include:(1) Pressure vessels which are designed to operate in excess of 15 pounds per square inch gauge without emissions to the atmosphere except under emergency conditions,(2) Subsurface caverns or porous rock reservoirs, or(3) Underground tanks if the total volume of petroleum liquids added to and taken from a tank annually does not exceed twice the volume of the tank.

4. Each tank, reservoir, or container used for the storage of petroleum liquids, but does not include:(1) Pressure vessels which are designed to operate in excess of 204.9 kPa (15 psig) without emissions to the atmosphere except under emergency conditions.(2) Subsurface caverns or porous rock reservoirs, or(3) Underground tanks if the total volume of petroleum liquids added to and taken from a tank annually does not exceed twice the volume of the tank.

5. Each tank, reservoir, or container used for the storage of volatile organic liquids but does not include:(1) Frames, housing, auxiliary supports, or other components that are not directly involved in the containment of liquids or vapors;(2) Subsurface caverns or porous rock reservoirs; or(3) Process tanks.

6. Tank or other vessel that contains an accumulation of crude oil, condensate, intermediate hydrocarbon liquids, or produced water, and that is constructed primarily of nonearthen materials (such as wood, concrete, steel, fiberglass, or plastic) which provide structural support. A well completion vessel that receives recovered liquids from a well after startup of production following flowback for a period which exceeds 60 days is considered a storage vessel under this subpart. A tank or other vessel shall not be considered a storage vessel if it has been removed from service in accordance with the requirements of § 60.5395(f) until such time as such tank or other vessel has been returned to service. A tank or other vessel shall not be considered a storage vessel if it has been removed from service in accordance with the requirements of § 60.5395(f) until such time as such tank or other vessel has been returned to service. For the purposes of this subpart, the following are not considered storage vessels:

7. Tank or other vessel that is designed to contain an accumulation of crude oil, condensate, intermediate hydrocarbon liquids, produced water, or other liquid, and is constructed primarily of non-earthen materials (e.g., wood, concrete, steel, plastic) that provide structural support. 8. Tank or other vessel (e.g., pressure vessel) that is part of an affected source and is used to store a gaseous, liquid, or solid feedstock, byproduct, or product that contains organic HAP. Storage vessel does not include: (1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Process tanks;(3) Vessels with capacities smaller than 10,040 gallons;(4) Vessels storing organic liquids that contain organic HAP only as impurities;(5) Bottoms receiver tanks;(6) Surge control vessels; and(7) Wastewater storage tanks. Wastewater storage tanks are covered under the wastewater provisions.

9. Tank or other vessel that is used to store organic liquids that contain one or more HAP and that has been assigned, according to the procedures in § 63.1360(f) or (g), to a PAI process unit that is subject to this subpart MMM. The following are not considered storage vessels for the purposes of this subpart:(1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere;(3) Vessels storing material that contains no organic HAP or contains organic HAP only as impurities;(4) Wastewater storage tanks; (5) Process tanks; and(6) Nonwastewater waste tanks.

10. Tank or other vessel that is used to store organic liquids that are used in the process as raw material feedstocks, produced as intermediates or final products, or generated as wastes. Storage vessel does not include vessels permanently attached to motor vehicles, such as trucks, railcars, barges or ships. [40 CFR 60.481 (CFR 2013)] [40 CFR 60.481a (CFR 2013)]

11. Tank or other vessel that is used to store liquids that contain one or more organic HAP. Storage vessels do not include:(1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere;(3) Vessels with capacities smaller than 38 cubic meters;(4) Vessels and equipment storing and/or handling material that contains no organic HAP and/or organic HAP as impurities only; (5) Wastewater storage tanks;(6) Surge control vessels or bottoms receivers; and(7) Vessels and equipment storing and/or handling amino/phenolic resin.

12. Tank or other vessel that is used to store diisocyanate or HAP ABA for use in the production of flexible polyurethane foam. Storage vessels do not include vessels with capacities smaller than 38 cubic meters (or 10,000 gallons).

13. Tank, container or other vessel that is used to store volatile liquids that contain one or more of the listed volatile HAP, benzene or methylene chloride, as raw material feedstocks or products. It also includes objects, such as rags or other containers which are stored in the vessel. The following are not considered storage vessels for the purposes of this subpart:(1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere;(3) Vessels storing volatile liquids that contain HAP only as impurities;(4) Wastewater storage tanks; and(5) Process vessels.

14. Tank or other vessel that is used to store liquids that contain one or more organic HAP. Storage vessels do not include:(1) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships;(2) Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere;(3) Vessels with capacities smaller than 38 cubic meters;(4) Vessels and equipment storing and/or handling material that contains no organic HAP, or organic HAP as impurities only;(5) Surge control vessels and bottoms receiver tanks;(6) Wastewater storage tanks; and(7) Storage vessels assigned to another process unit regulated under another subpart of part 63.

15. For the purposes of regulation under the storage vessel provisions of this subpart, means a stationary unit that is constructed primarily of nonearthen materials (such as wood, concrete, steel, fiberglass, or plastic) that provides structural support and is designed to hold an accumulation of liquids or other materials. Storage vessel includes surge control vessels and bottoms receiver vessels. For the purposes of regulation under the storage vessel provisions of this subpart, storage vessel does not include vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships; pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere; or wastewater storage vessels. 16. Tank or other vessel that is used to store liquids that contain one or more organic HAP. Storage vessels do not include: Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships; Pressure vessels designed to operate in excess of 204.9 kilopascals and without emissions to the atmosphere; Vessels with capacities smaller than 38 cubic meters; Vessels and equipment storing and/or handling material that contains no organic HAP, or organic HAP as impurities only; Surge control vessels and bottoms receivers; and Wastewater storage tanks.

17. Tank or other vessel that is used to store organic liquids that contain one or more of the organic HAP's listed in table 2 to this subpart and that has been assigned, according to the procedures in § 63.100(g), to a chemical manufacturing process unit that is subject to this subpart. Storage vessel does not include: (i) Vessels permanently attached to motor vehicles such as trucks, railcars, barges, or ships; (ii) Vessels with capacities smaller than 38 cubic meters; (iii) Except for storage vessels in ethylene oxide service, vessels storing organic liquids that contain organic hazardous air pollutants only as impurities; (iv) Bottoms receiver tanks; (v) Surge control vessels; or (vi) Wastewater storage tanks. Wastewater storage tanks are covered under the wastewater provisions.
