Counsel selection provision

A clause in a liability insurance policy that specifies who has the right to choose legal counsel to defend the insured in the event of a claim or lawsuit. Some policies grant this right to the insurer, while others allow the insured to select their own attorney, sometimes subject to the insurer's approval. This provision can be a point of negotiation between insureds and insurers.
