Cumis counsel

An independent attorney appointed to represent an insured when a conflict of interest arises between the insured and the insurer regarding defense of a claim. This conflict occurs when the insurer's defense strategy could prejudice the insured's interests, such as when the insurer reserves its right to deny coverage. The insurer is obligated to pay for the reasonable fees of this separate counsel.
