Terms of a Clean Water Act permit for discharges (section 402) or for dredged or fill material (section 404), whose breach exposes the permit holder to a compliance order or to civil or criminal prosecution under the Act or a state counterpart. If no permit exists yet, the term covers any requirement the EPA regional administrator expects would be written into it. The definition comes from the EPA wastewater treatment grant regulations at 40 CFR 35.2005.
