Escape provision

A clause in an insurance policy that attempts to relieve the insurer of liability if other valid and collectible insurance covers the same loss. These clauses are designed to prevent duplicate recovery and determine which policy is primary or secondary. Courts often disfavor escape clauses, sometimes ruling them unenforceable if they conflict with public policy or other policy provisions.
