Restitution of fees

A remedy requiring a party to repay fees it collected, such as a lawyer or consultant ordered to return fees paid for deficient services. Professional liability policies commonly exclude claims seeking the return of fees, since refunding fees is treated as a business cost rather than damages. The UK market calls the same carve-out a fee refund exclusion.
