Tender of defense

The formal notification by an insured party to their insurer, requesting that the insurer assume the responsibility for defending a lawsuit filed against the insured. This action triggers the insurer's duty to defend under the terms of the liability policy. Upon receiving a tender of defense, the insurer must determine if the claim falls within the policy's coverage and either accept the defense or issue a reservation of rights letter.
