Third-party-over action

A lawsuit brought by an injured employee against a third party, other than their employer, who is responsible for the injury, after the employee has received workers' compensation benefits from their employer. The third party then seeks to recover damages from the employer, alleging the employer's negligence contributed to the injury. This action bypasses the exclusive remedy provision of workers' compensation laws.
