Survival action

A legal claim brought by the estate of a deceased person to recover damages for the pain, suffering, and other losses the deceased experienced between the time of injury and death. Unlike a wrongful death action, which compensates surviving family members for their own losses, a survival action seeks to recover damages that the deceased could have claimed had they lived. Damages typically include medical expenses and lost wages prior to death.
