Trade dress

The overall commercial image and aesthetic of a product or service that identifies its source and distinguishes it from others. It encompasses the total design, including features such as size, shape, color or color combinations, texture, and graphics. To be legally protected under the Lanham Act, a trade dress must be inherently distinctive or have acquired a secondary meaning in the marketplace and its features must be nonfunctional.
