Nisi prius

A court of original jurisdiction where a case is first heard and tried before a single judge, often with a jury. The term, Latin for "unless first," historically described a writ directing a case to be tried in the central court at Westminster unless a judge first came to the county to hear it. Today, it distinguishes trial-level courts, where facts are determined, from appellate courts, which review questions of law.
