Byproduct material
Term · Environment · MLC-T-ENV-003885
1. A legal definition from Section 11(e) of the Atomic Energy Act. As defined by Nuclear Regulatory Commission (NRC) regulations, byproduct material includes any radioactive material (except enriched uranium or plutonium) produced by a nuclear reactor. It also includes the tailings or wastes produced by the extraction or concentration of uranium or thorium or the fabrication of fuel for nuclear reactors. Additionally, it is any material that has been made radioactive through the use of a particle accelerator or any discrete source of radium-226 used for a commercial, medical, or research activity. In addition, the NRC, in consultation with the EPA, DOE, DHS and others, can designate as byproduct material any source of naturally-occurring radioactive material, other than source material, that it determines would pose a threat to public health and safety or the common defense and security of the United States. For additional detail, see https://www.nrc.gov/materials/byproduct-mat.html.
2. Meaning contained in the Atomic Energy Act of 1954, 42 U.S.C. 2014 et seq., and the regulations issued thereunder
3. Radioactive materials left over from the production or use of plutonium, enriched uranium or uranium-233.
4. Byproduct materials are (i) any radioactive material (except special nuclear material) yielded in, or made radioactive by, exposure to the radiation incident to the process of producing or using special nuclear material (as in a reactor); and (ii) the tailings or wastes produced by the extraction or concentration of uranium or thorium from ore processed primarily for its source material content, including discrete surface wastes resulting from uranium solution extraction processes. Underground ore bodies depleted by these solution extraction operations do not constitute "byproduct material" within this definition.
5. A legal definition from the Atomic Energy Act. The tailings or wastes produced by the extraction or concentration of uranium or thorium from any ore processed primarily for its source material content. See: Byproduct material.
