Motion to dismiss

A formal request by a party in a lawsuit, asking a court to reject a complaint or parts of it without a trial. The motion argues that the opposing party's claim is legally invalid, even if the factual allegations are assumed to be true. Common grounds for dismissal include failure to state a claim for which the law offers a remedy, lack of jurisdiction over the subject matter, or an expired statute of limitations.
