Prior and pending litigation exclusion

A provision in an insurance policy that excludes coverage for claims arising from lawsuits that were filed or were ongoing before the policy's inception date. This exclusion prevents an insured from obtaining coverage for known or existing legal exposures. It is a standard clause in many professional liability and directors and officers liability policies.
