Putative class action

A lawsuit filed by one or more individuals on behalf of a larger group of people who have suffered similar harm, but which has not yet been certified by a court as a class action. The court must determine if the proposed class meets specific legal criteria, such as commonality and typicality of claims, before it can proceed as a class. Until certification, the action remains 'putative' or alleged.
