Aggravating circumstances

Facts or conditions that increase the culpability of a defendant or the severity of a criminal offense. These circumstances are considered by a court during sentencing to justify a harsher penalty. Examples include the use of a weapon, the vulnerability of the victim, or a defendant's prior criminal record.
