Aggravating factor

A specific element or condition related to a crime or a defendant that increases the seriousness of the offense or the blameworthiness of the perpetrator. Judges consider these factors during sentencing to determine an appropriate punishment. The presence of an aggravating factor can lead to a longer prison sentence or, in some jurisdictions, the death penalty.
