Mitigating factor

An element or condition that, while not excusing a crime or tort, serves to lessen the moral culpability of the offender or the severity of the penalty. Judges consider these factors during sentencing to impose a more lenient sentence. Conversely, aggravating factors increase the severity of the punishment.
