Election under the will

The choice a surviving spouse must make when a deceased spouse's will attempts to dispose of the surviving spouse's community property or other separate interest. The survivor must either accept the benefits provided in the will (and allow their own property to be disposed of as the will directs) or reject the will's provisions and assert their independent property rights. State law dictates the specific time frame and procedure for making this binding election.
