Election of remedies

A legal doctrine requiring a plaintiff who has suffered a single wrong to choose between two or more inconsistent remedies available for that wrong. Once a choice is made and pursued to a final judgment, the plaintiff is barred from seeking any of the alternative remedies. For example, a party to a contract breached by another must elect to either rescind the contract and seek restitution or affirm the contract and sue for damages.
