Ex parte divorce

A divorce decree obtained by one spouse when the other does not appear or is not subject to the court's personal jurisdiction. The court has authority over the marital status itself if the petitioner is domiciled in the state, but it cannot award alimony or divide property against an absent spouse, a rule known as the divisible divorce doctrine. Child custody follows separate jurisdictional rules under the UCCJEA.
